The Usefulness of Medicine for the Administration of Justice: The Medical Expert Evidence in Royal Academies of Medicine

RESUMEN

La Prueba Pericial Médica aporta al Juez la información científica necesaria para que éste comprenda el hecho, lo valore de acuerdo a las leyes y dicte una sentencia justa y acorde con el estado de los conocimientos del momento.

Las Reales Academias de Medicina, acorde con la Ley de Enjuiciamiento Civil, han sido siempre organismos consultivos de la Administración de Justicia y tienen, en sus Estatutos, a la pericia médica como uno de sus fines primordiales. Exponemos el procedimiento a seguir para realizar una pericia colegiada, acorde con lo recogido en la LEC.

ABSTRACT

Medical Expert Evidence gives the judge the scientific information needed to understand the fact, so that he could value it according to the laws and sentence a fair judgment, reflecting the state of current knowledge.

The Royal Academies of Medicine, according to the Civil Procedure Act, have always been advisory bodies of the Administration of Justice and have, in their Statutes, medical expert evidence as one of its main purposes.
We describe the procedure to perform a collegial expertise, consistent with that contained in the Civil Procedure Act.
